2. Scope of Services

Our typical services include the collection, loading and transportation of general household rubbish, garden waste, bulky items, light construction waste, and commercial waste, subject to applicable laws and regulations.

We do not collect prohibited or hazardous materials unless expressly agreed in writing and in compliance with relevant licences and regulations. Prohibited items may include, but are not limited to, asbestos, certain chemicals, solvents, medical waste, gas bottles, and any substance classified as hazardous under UK law.

The exact nature of the Services to be provided, including type and approximate volume of waste, access arrangements and timing, will be agreed with the Customer during the booking process.

3. Booking Process

3.1 Bookings can be made by telephone, email, online enquiry, or other communication methods offered by Rubbish Removal Balham. A booking is not considered final until it has been confirmed by us.

3.2 At the time of booking, the Customer must provide accurate and complete information, including:

a. The collection address and any access restrictions.

b. A description of the type and approximate volume or weight of waste to be removed.

c. Any items that might require special handling.

d. Any time constraints or deadlines.

3.3 Any estimate or quotation provided prior to arrival is based on the information supplied by the Customer and is subject to visual inspection by our operatives on site. If the volume, type, or nature of the waste differs significantly from the original description, we reserve the right to revise the price or refuse to provide the Services.

3.4 The Customer is responsible for ensuring that either the Customer or an authorised representative is present at the premises at the agreed time to grant access, confirm the items to be removed, and approve any charges.

4. Pricing and Quotations

4.1 Our pricing is generally based on the volume and type of waste, the weight where relevant, the labour involved in loading, and any additional services that may be required such as dismantling or extra lifting.

4.2 Any price stated in advertising or general price lists is indicative and may vary depending on the circumstances at the site.

4.3 We will provide the Customer with an estimated price or a price range in advance based on the information supplied. The final price will be confirmed once our operatives have inspected the waste to be collected.

4.4 All prices are exclusive of any applicable taxes or additional fees unless otherwise stated. Where VAT or similar taxes apply, these will be added to the invoice in accordance with current law.

5. Payments and Invoicing

5.1 Unless agreed otherwise in writing, payment is due immediately upon completion of the Services on the day of collection.

5.2 We accept various payment methods, which may include cash, debit or credit card, or bank transfer. The accepted methods will be confirmed at the time of booking or upon arrival.

5.3 Where services are provided to business customers or on account, alternative payment terms may be agreed in writing. In such cases, invoices must be paid in full within the period stated on the invoice.

5.4 If the Customer fails to pay any amounts due on time, Rubbish Removal Balham may charge interest on late payments at the maximum rate permitted by UK law, together with any reasonable costs incurred in recovering the outstanding debt.

6. Cancellations and Rescheduling

6.1 The Customer may cancel or reschedule a booking by giving us reasonable notice prior to the scheduled arrival time.

6.2 If the Customer cancels less than 24 hours before the scheduled time, we reserve the right to charge a late cancellation fee to cover administrative and operational costs.

6.3 If our operatives attend the site at the agreed time and are unable to gain access, or if the Customer is not present and has not made alternative arrangements for access, we may treat the booking as cancelled and a call-out or wasted journey fee may be payable.

6.4 Rubbish Removal Balham reserves the right to cancel or reschedule a booking in the event of circumstances beyond our reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, or safety concerns. In such cases, we will endeavour to notify the Customer as soon as reasonably possible and offer the next available appointment.

7. Customer Obligations

7.1 The Customer must ensure that our operatives have safe and reasonable access to the waste to be collected, including suitable parking or loading space for our vehicle where possible.

7.2 The Customer must ensure that the waste to be removed is clearly separated from items that are not to be taken. Our operatives will not be responsible for any confusion where waste has not been clearly identified.

7.3 The Customer warrants that the waste presented for collection does not contain prohibited or hazardous materials unless specifically agreed and that it is their responsibility to inform us of any items requiring special handling.

7.4 The Customer shall take reasonable steps to ensure the safety of our operatives while on their premises, including notifying us of any hazards, risks or restrictions relevant to the site.

8. Performance of Services

8.1 Our operatives will use reasonable care and skill when carrying out the Services and will endeavour to complete the job efficiently and safely.

8.2 We will make reasonable efforts to arrive within any time window agreed with the Customer, but all times are approximate. We do not guarantee exact arrival or completion times and are not liable for any losses arising from delays, provided we act with reasonable care and diligence.

8.3 We reserve the right to refuse to carry out the Services, or to cease work immediately, if our operatives consider that the conditions at the site pose a risk to health and safety, are illegal, or involve prohibited waste. In such cases, a call-out fee may be payable at our discretion.

9. Waste Handling and Disposal

9.1 Rubbish Removal Balham operates in accordance with applicable UK waste legislation and environmental regulations, including the duty of care relating to controlled waste.

9.2 All collected waste will be transported to licensed waste transfer stations, recycling facilities or disposal sites as appropriate. We aim to maximise recycling and responsible disposal in line with best practice.

9.3 Once the waste has been loaded onto our vehicle and payment has been made or agreed, ownership of the waste transfers to Rubbish Removal Balham, except where otherwise required by law.

9.4 We will not be responsible for any items mistakenly included with the waste once they have been removed from the Customer’s premises, unless the loss arises from our proven negligence and the items were clearly identified as not to be taken.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under UK law.

10.2 Subject to the above, Rubbish Removal Balham shall not be liable to the Customer for any indirect, consequential or economic loss, including loss of profit, loss of business, or loss of opportunity arising out of or in connection with the Services.

10.3 Our total liability for any claim arising out of or in connection with a particular booking shall not exceed the total amount paid or payable by the Customer for the Services under that booking.

10.4 The Customer is responsible for protecting floors, walls, fixtures and fittings if they consider that they may be susceptible to damage during the removal of bulky items. While our operatives will exercise reasonable care, we are not liable for normal wear and tear, minor scuffs, or damage that could have been avoided by taking reasonable precautions.

10.5 We shall not be responsible for any delay or failure to perform our obligations where such delay or failure is due to events beyond our reasonable control, including but not limited to acts of God, extreme weather, strikes, public emergencies, or failure of transport networks.

11. Waste Regulations and Customer Responsibilities

11.1 The Customer acknowledges their duty of care under UK waste regulations and agrees to cooperate with Rubbish Removal Balham to ensure lawful handling of controlled waste.

11.2 Where required, we may issue a waste transfer note or similar documentation, and the Customer must provide accurate details for this purpose.

11.3 The Customer confirms that they are legally entitled to dispose of the waste presented for collection and that it has not been obtained unlawfully.

11.4 If incorrect or misleading information provided by the Customer results in a breach of waste regulations or additional costs, the Customer may be held responsible for any resulting penalties, charges or expenses.

12. Complaints and Disputes

12.1 If the Customer is dissatisfied with any aspect of the Services, they should contact Rubbish Removal Balham as soon as possible, providing details of the issue, the date of service, and any relevant evidence.

12.2 We will investigate complaints in a fair and timely manner and will aim to resolve issues by repair, re-performance of the Services, partial refund, or other appropriate remedy where justified.

12.3 If a dispute cannot be resolved directly between the parties, either party may seek to resolve the matter through any available legal or alternative dispute resolution procedure.

13. Privacy and Data Protection

14. Amendments to These Terms

17. Governing Law and Jurisdiction

17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
